Bikvey Pakistan Terms & Conditions

Welcome to Bikvey! These Terms and Conditions outline the rules and regulations for using our platform. By accessing or using Bikvey, you agree to comply with these terms. Please read them carefully before proceeding.

1. Introduction to Bikvey

Bikvey is an online marketplace that connects buyers and sellers, offering a wide range of products and services. Our platform is designed to provide a seamless and secure shopping experience for all users.

2. Acceptance of Terms

By using Bikvey, you confirm that you accept these Terms and Conditions and agree to abide by them. If you do not agree with any part of these terms, you must not use our platform.

3. Eligibility and License

By accessing Bikvey, you confirm that you are capable of forming legally binding contracts. Therefore, you must be at least 18 years of age or accessing the platform under the supervision of a parent or legal guardian.

We grant you a non-transferable, revocable, and non-exclusive license to use Bikvey in accordance with these Terms and Conditions. This license is solely for personal shopping purposes and does not permit commercial use or use on behalf of any third party unless explicitly authorized by us in advance.

If you are registering as a business entity, you represent that you have the authority to bind that entity to this agreement and that both you and the entity will comply with all applicable laws related to online trading. Each person or business entity may only register once on Bikvey. Any violation of these terms will result in the immediate revocation of your license without prior notice.

4. User Conduct

You agree not to use Bikvey in any way that could harm the platform, its functionality, or its users. Prohibited activities include but are not limited to:

  • Causing damage, interruption, or impairment to the platform or its services.
  • Engaging in fraudulent activities, criminal offenses, or unlawful behavior.
  • Posting, sharing, or transmitting content that is illegal, offensive, deceptive, abusive, harassing, defamatory, obscene, or otherwise objectionable.
  • Using the platform to promote racism, bigotry, hatred, violence, or any form of discrimination.
  • Infringing on intellectual property rights, including copyrights, trademarks, or confidentiality agreements.
  • Impersonating another person or entity.
  • Threatening the unity, integrity, or security of Pakistan or its relations with foreign states.
  • Uploading or distributing viruses, malware, or any harmful software.
  • Engaging in spamming, phishing, or other unsolicited commercial activities.

Any breach of these rules may result in the immediate termination of your account and legal action, if necessary.

5. User Submissions

Any content you submit to Bikvey, including questions, reviews, comments, or suggestions, becomes our sole and exclusive property. By posting such content, you grant us the right to use your name and the content in connection with our platform.

You agree not to use false information, impersonate others, or mislead us or other users about the origin of your submissions. We reserve the right to remove or edit any content without notice.

6. Claims Against Objectionable Content

Bikvey operates on a "claim, review, and takedown" basis. If you encounter any content that you believe is illegal, offensive, or otherwise objectionable, please notify us immediately at [support@bikvey.com]. Provide your name, contact information, and detailed evidence of the objectionable content.

We will investigate and remove valid complaints within a reasonable time. Incomplete or inaccurate claims may not be processed.

7. Claims Against Infringing Content

If you believe your intellectual property rights have been violated on Bikvey, please contact us at [[email protected]]. Provide your name, contact details, and evidence of the infringement.

We will address valid claims promptly. Note that false or misleading claims may result in legal consequences.

8. Trademarks and Copyrights

All trademarks, logos, and content on Bikvey are the property of Bikvey or its licensors. Unauthorized use of these materials is strictly prohibited.

You may not use Bikvey’s trademarks, logos, or proprietary information in any way that could cause confusion or discredit the platform. All intellectual property rights, including copyrights, are reserved.

9. Disclaimer

Bikvey provides the platform "as is" and makes no warranties regarding the accuracy, reliability, or completeness of the content. We are not responsible for the actions or inactions of sellers, manufacturers, or third-party service providers.

You acknowledge that you use Bikvey at your own risk and that we are not liable for any disputes between buyers and sellers.

10. Indemnity

You agree to indemnify and hold Bikvey, its affiliates, and their representatives harmless from any claims, damages, or losses arising from your use of the platform or violation of these terms.

11. Third-Party Services

Bikvey may link to or host services provided by third parties. We are not responsible for the content, actions, or policies of these third parties. Use third-party services at your own risk.

12. Communication

By using Bikvey, you consent to receive communications from us via email, SMS, or other methods. These communications may include transactional, promotional, or service-related messages.

13. Limitation of Liability

Bikvey is not liable for any indirect, incidental, or consequential losses, including loss of profits, data, or goodwill. Our liability is limited to the maximum extent permitted by law.

14. Amendments

We reserve the right to update these Terms and Conditions at any time. Changes will be effective immediately upon posting. Your continued use of Bikvey constitutes acceptance of the revised terms.

15. Governing Law

These Terms and Conditions are governed by the laws of the Islamic Republic of Pakistan. Any disputes will be resolved exclusively by the courts in Karachi, Pakistan.

16. Termination

We may terminate your access to Bikvey at any time for violations of these terms. Termination will not affect any rights or
obligations incurred prior to the termination date.

17. Contract

Your order represents a legal offer to the seller to purchase the product or service displayed on our platform, Bikvey. When you place an order to buy a product, any confirmations or status updates received before the dispatch of your order are solely intended to validate the details provided and do not imply confirmation of the order itself. The acceptance of your order is confirmed only when the product is dispatched to you. If your order is split into multiple packages, you may receive separate dispatch confirmations.

At the time of placing the order, we provide an estimated timeline for processing your order. However, we cannot guarantee that this timeline will be exact in every case, as we rely on third-party service providers to fulfill this commitment. We will, however, make every reasonable effort to ensure that the estimated timeline is met.

All commercial and contractual terms, including but not limited to price, shipping costs, payment methods, payment terms, delivery dates, periods, modes of delivery, product warranties, and after-sales services, are offered and agreed upon solely between you and the sellers. Bikvey does not control, determine, advise, or involve itself in any way in the offering or acceptance of such terms between you and the sellers.

The seller reserves the right to cancel any order at their sole discretion before dispatch. In such cases, we will ensure timely notification of the cancellation via email or SMS. Any prepayments made for canceled orders will be refunded to you within the stipulated time frames.

By placing an order, you confirm that the product(s) or service(s) ordered are for personal or internal use and not for commercial resale. You authorize us to declare and provide any necessary documentation to governmental authorities on your behalf, stating that the products are for personal consumption.

Both the seller and Bikvey reserve the right to cancel orders where the quantities exceed typical individual consumption. This applies to both the number of products ordered in a single order and the placement of multiple orders for the same product that collectively exceed typical individual consumption limits. The determination of what constitutes a typical individual consumption quantity is based on various factors and is at the sole discretion of the seller or Bikvey. These limits may vary from individual to individual.

You may cancel your order at no cost at any time before the item is dispatched to you.

Please note that Bikvey sells products only in quantities that align with the typical needs of an average household. This applies to both the number of products ordered in a single order and the placement of multiple orders for the same product that collectively reflect a quantity typical for a normal household.

Important Note: If your return request is declined, the item will be sent back to you within 3-5 business days. If the delivery attempt fails three times, the item will be scrapped.

PRICING, AVAILABILITY, AND ORDER PROCESSING

19. PRICING, AVAILABILITY, AND ORDER PROCESSING


All prices listed on Bikvey are in Rupees and include GST. These prices are set by the seller offering the product or service. The items in your Shopping Cart will always reflect the most up-to-date price displayed on the product’s detail page. Please be aware that this price may differ from the price shown when you initially added the item to your cart. Adding an item to your cart does not lock in the price displayed at that moment. Additionally, an item’s price may decrease between the time you add it to your cart and the time you complete your purchase.

Bikvey does not offer price matching for items sold by sellers on our platform or on other websites.

While we strive to provide accurate pricing information, errors may occasionally occur, such as incorrect price displays. In such cases, we reserve the right to refuse or cancel any order. If an item is mispriced, we may, at our discretion, either contact you for further instructions or cancel the order and notify you. This applies even if your order has been confirmed and payment has been processed. If a prepaid order is canceled, our refund policies will apply.

Product availability information is provided on the product detail pages. However, we cannot guarantee specific availability beyond what is stated. Dispatch estimates are provided as guidelines only and are not guaranteed timelines. You will be notified via email or SMS if any ordered items become unavailable during processing.

Bikvey reserves the right to refuse or cancel any order for any reason at any time. In some cases, we may request additional verification or information, such as your phone number or address, before accepting an order.

To prevent credit or debit card fraud, we may validate your payment details and verify the personal information you provide before processing your order. This may include checks on identity, residence, or banking information. Failure to respond to such verification requests may result in the cancellation of your order within a reasonable timeframe. We also reserve the right to cancel orders suspected of fraudulent activity or other risks without prior notice or liability.

REFUND VOUCHERS Refund vouchers can be used on our platform as full or partial payment for products within the specified validity period.

  • Refund vouchers are non-transferable and can only be used by the account holder.
  • Expired vouchers cannot be replaced or reinstated.

PROMOTIONAL VOUCHERS

  • Each promotional voucher (e.g., app vouchers or new customer vouchers) is valid for one-time use per customer.
  • Promotional vouchers are non-refundable, cannot be exchanged for cash, and are valid for a single transaction only.
  • They may not be applicable during sales or in conjunction with other special promotions.
  • Vouchers are valid only if the minimum purchase amount and other specified conditions are met.
  • Bikvey reserves the right to modify or terminate any voucher’s validity at any time without prior notice.
  • Bikvey is not liable for any financial loss resulting from the refusal, cancellation, or withdrawal of a voucher or a customer’s inability to use it.
  • Expired vouchers cannot be replaced.

SECURITY AND FRAUD

By using a voucher, you confirm that you are the authorized recipient and are using it in good faith.

  • Misusing vouchers, attempting to redeem unauthorized discounts, or encouraging such actions may constitute a civil or criminal offense.
  • If we suspect unlawful or illegal use of a voucher, we reserve the right to reject or cancel the voucher or order. You agree not to hold Bikvey liable for such actions.
  • Bikvey may take further action as deemed necessary in cases of suspected fraud or misuse.

20. Taxes

You are responsible for all fees, costs, and charges related to your purchases on the platform. Additionally, you agree to pay any applicable taxes as required by the prevailing laws.

21. COMMUNICATION WITH US

 When you visit Bikvey or contact us via email, you are engaging in electronic communication. To place an order, you must provide a valid phone number. We may communicate with you through email, SMS, phone calls, website notifications, or any other method we deem appropriate. By using the platform, you consent to receive communications (including transactional, promotional, and/or commercial messages) related to your use of the website or orders placed. You agree to treat all such communications with equal importance.

22. LIABILITY FOR LOSSES

       Bikvey is not liable for any business or personal losses, including but not limited to lost profits, revenue, contracts, anticipated savings, data, goodwill, or unnecessary expenses. We are also not responsible for any indirect or consequential losses that could not have been reasonably foreseen when you began using the platform.

23. CHANGES TO TERMS OR SERVICES

     We reserve the right to modify the platform, its policies, these terms and conditions, or any other publicly stated terms at any time. The policies and terms in effect at the time of your use will apply unless changes are mandated by law or government authorities, in which case they may apply retroactively. If any part of these terms is found to be invalid or unenforceable, the remaining terms will remain in full effect.

24. FORCE MAJEURE

       Bikvey will not be held liable for any delay or failure to fulfill our obligations under these terms if such delay or failure results from circumstances beyond our reasonable control. This clause does not affect your statutory rights.

25. WAIVER OF RIGHTS

       You acknowledge that Bikvey is a private commercial entity and reserves the right to operate in a manner that aligns with our objectives. If you violate these terms and we choose not to take immediate action, we retain the right to enforce our rights and remedies in the event of future breaches.

26. GOVERNING LAW AND JURISDICTION

       These terms and conditions are governed by and interpreted in accordance with the laws of the Islamic Republic of Pakistan. Both you and Bikvey agree to submit to the exclusive jurisdiction of the courts located in Karachi.

26. REPRESENTATIONS AND WARRANTIES

           Bikvey does not make any guarantees regarding the quality, value, or saleability of products or services listed on the platform, especially when these are offered by third-party sellers. We do not explicitly or implicitly endorse any products or services available on the platform. We are not liable for any errors, omissions, or inaccuracies, whether on our part or that of third parties.

We are not responsible for any breach or non-performance of contracts between you and sellers. We cannot guarantee the actions of either party during transactions on the platform. Bikvey is not obligated to mediate or resolve disputes arising from transactions conducted on the platform.

At no point during a transaction does Bikvey assume ownership or any rights over the products or services offered by sellers. Consequently, we have no obligations or liabilities regarding contracts formed between you and sellers. We are not responsible for unsatisfactory or delayed services, damages, or delays caused by out-of-stock, unavailable, or back-ordered products.

In the event of incorrect pricing or product information due to technical errors, typographical mistakes, or other reasons, the seller or Bikvey may cancel your order without prior notice or liability. Any prepayments made for such orders will be refunded in accordance with our refund policy.

27. Buyer Policy

1. INTRODUCTION

1.1 All users and buyers of the Bikvey Online Platform (referred to as “Buyers”) are expected to adhere to the guidelines outlined in this Buyer Policy, as well as the Bikvey Platform Terms of Use and all other applicable terms and conditions. These documents are incorporated by reference into this Buyer Policy.

1.2 Bikvey is dedicated to fostering a trusted and reliable platform for our community. This Buyer Policy ensures the smooth and secure operation of the Bikvey Online Platform, aiming to provide a positive shopping experience for all users.

2. POLICY AND ENFORCEMENT

2.1 Buyers are required to comply with the rules outlined in Table 1 below.

2.2 If a Buyer fails to adhere to these rules, Bikvey may take one or more of the following actions without prior notice or warning:

  • Suspend, cancel, terminate, block, or reverse any transaction conducted by the Buyer on the Bikvey Online Platform.
  • Modify or remove affected messages, content, or features accessible to the Buyer.
  • Restrict, suspend, or terminate the Buyer’s access to the Bikvey Online Platform.
  • Close or limit access to the Buyer’s Bikvey account.

2.3 The rules listed in Table 1 are not exhaustive. Bikvey reserves the right to take additional enforcement actions, including reporting misconduct to regulators or law enforcement agencies, if necessary.

Account Registration

  • Do not create multiple accounts to exploit incentives, promotions, or gain unfair advantages.
  • Do not register accounts using false, forged, or compromised details (e.g., email address, phone number, delivery address, etc.). Avoid using information belonging to other individuals or users.
  • Do not tamper with device software or Bikvey applications to install unauthorized software, clone applications, or bypass security features.

Transactions

  • Honor all agreements made through official Bikvey communication channels or policies.
  • Do not engage in fraudulent activities, including:
    • Misleading or defrauding Bikvey or other users.
    • Creating accounts for the purpose of generating fake transactions.
  • Keep all transactions within the Bikvey Platform.
    • Do not engage in offline payments or transactions with other users.
    • Do not encourage others to conduct transactions outside the Bikvey Platform.
    • Avoid redirecting sales to other platforms or channels.
  • Complete all payments for Bikvey transactions within the platform.
  • Use only official Bikvey communication channels for exchanging messages and information.
  • Bikvey is not liable for transactions conducted outside the platform.
  • Provide accurate shipping addresses and do not reject deliveries without valid reasons. If a product is defective or incorrect, accept the delivery and follow Bikvey’s return policy.

Post-Transaction

  • Provide honest and accurate feedback about products and services.
  • Do not post false, misleading, or inappropriate reviews, or any content that is discriminatory, threatening, or violates the law.
  • Do not initiate payment disputes if a refund has already been issued by the seller or your payment provider.

This Buyer Policy is designed to maintain a safe, fair, and enjoyable shopping environment for all Bikvey users. By using the platform, you agree to abide by these rules and understand the consequences of non-compliance.
